ARCHBISHOP VISITS THE ATTACKED CROOSWATTA CHURCH

His Grace Archbishop Malcolm Ranjith visited the Crooswatta Church and the Catholic families in the area today and met the Parish Priest Fr. Jude Lakshman and other Fathers in the Parish.

Archbishop Malcolm having seen the vandalism and the destruction done to the church, said, " this cannot be by someone know practice a religion, if a man adheres to what his religion teaches, he would never touch this church " .

His Grace knelt down in the church and prayed with the other Fathers present and asked the Lord to strengthen the faith of the persecuted community. Fr. Lakshman was in tears as Archbishop said a very moving prayer to Our Blesses Mother to intercede for the Catholics at Crooswatta.

Beside Fr. Lakshman, Fr. Ranjan Silva the Dean of Tudella, Fr. Henry Silva and Fr. Sampath Thushara were present.

His Grace Archbishop Malcolm insisted, if the Supreme Court has granted the permission to proceed with the completion of the construction work of the Church, we should proceed and inform the Supreme Court that the church and the people were attacked inside the church and ask for justice.

CROOSWATTA CHURCH ATTACKED BY AN UNRULY MOB
SET FIRE TO VEHICLES AND CAUSE HEAVY DAMAGES

Crooswatta Church in Kotugoda Parish was attacked by an unruly mob today, 06th Dec.2009, after the Holy Mass was celebrated in the morning by the Parish Priest Rev. Fr. Jude Denzil Lakshman. An infuriated mob of more than 1000 people armed with battons and swords, set fire to the vehicles and went berserk attacking the statues and the faithful who were about to go home after the Holy Mass. They also damaged the statues, Holy Altar, chairs and everything that was inside church.

On 28th July 2008, the Supreme Court ordered the completion of the construction of the Crooswatta Church, which was stopped following a repeated disruption by an armed group, and also Holy Eucharist to be celebrated and Daham Pasal classes ( Catechism Classes ) to be held and directed the Inspector General of Police to produce any body who violates the order before court.

The construction work commenced few days ago by the Parish Priest Rev. Fr.Lakshman and on the following day the lorry drivers transporting building materials, were threatened not to bring anything to the site of the church. Inspite of few incidents, the completion of the roof work continued until today when the mob attacked the church.

A Catholic who participated in the Holy Mass said, " Fr. Lakshman came out of the Church after the Holy Mass to greet the faithful and then we saw this mob was coming towards the church. As soon as the mob approached the church, they set fire to Fr. Lakshman's car and then someone attempted to strike him with a sword, but Fr. Lakshman had a narrow save when a youth pulled him out of the strike, and then damaged all other motor bikes, ordinary cycles of the poor people including a three-wheeler. Some persons armed with swords and battons went on beating the people. There are six Catholics in the hospital with cuts and injuries".

Since the Crooswatta church is closer to the Ekala Air Force camp, the sooner the news went around, Air Force personnel were deployed to bring the situation under control and to provide security to the people. His Excellency President Mahinda Rajapaksha having heard about the situation, had immediately directed the IGP Mahinda Balasuriya and several other top rank Police Personnel to visit the area and to provide immediate security. IGP Mahinda Balasuriya, several other DIGs and Hon. Sarath Gunaratne Deputy Minister of Aviation, personally visited the church site and made investigations of the incidents.

IGP Balasuriya ordered a police post to be established around the church site and deploy sufficient police personnel and STF to protect the church and the civilians. The Catholics complained to IGP that the OIC of Ja-ela police has been very passive in all the recent incidents and even when people caught few members of the mob and then handed them over to the police, the police had released them. According to the information received only one person has been arrested. It was this same Officer in Charge of Ja-ela Police abruptly stopped the celebration of the Holy Mass by Rev. Fr. Siri Cooray on 06th October 2007. Even when the IGP Balasuriya visited the Crooswatta church site today, OIC of Ja-ela Police was not to be seen in the site. The Episcopal Vicar of the Region Very Rev. Fr. Cyril Gamini Fernando, Rev. Fr. Ranjan Silva-Dean of Tudella and several Rev. Fathers who were present discussed with the IGP Balasuriya about the continuous incidents that had taken place and also requested him to inquire as to why Ja-ela Police had failed to give the necessary protection, inspite of an order given by the Supreme Court.

His Grace Archbishop Malcolm Ranjith spoke over the phone to several DIGs present and the Commander of the Air Force Base at Ekala and requested further protection not only to the church but also very specially to the lives of the Catholics.

The mob went berserk attacking and damaging the houses of the Catholics in the area and one mother cried before the IGP, " these people not only destroyed everything in my house, they destroyed even the milk-bottle of my baby. Sir, last time also they attacked my house and caused heavy damages costing nearly Rs. 300,000/- to repair the house ".

Rev. Fr. Lakshman categorically denied the baseless rumors that spread around, saying that a Catholic had thrown a stone at a Buddhist place and said no Catholic is involved in such an incident. It looks very evident that the attack was very well planned and the mob waited till the Holy Mass was over for the Priest and the Catholics to come out of the church. The Buddhists and the Catholics have been living in harmony in the area and the police need to find the culprits behind these incidents instigating attacks on this church at Crooswatta.

There are nearly 295 Catholic families living at Crooswatta, belonging to the Parish of Kotugoda, which is about 4km away from Ja-ela.

Several other government officers, including Katana electorate organizer Dr. Sudharshani Fernandopulle and UNP MP John Amaratunga were present at the site.

Supreme Court Orders the construction of the Crooswatta Church to continue

The Supreme Court ordered the completion of the construction of the Crooswatta Church, which was stopped following a repeated desruption by an armed group be continued, Holy Eucharist to be celebrated and Daham Pasal classes to be held and directed the Inspector General of Police to produce any body who violates the order before court.
 
The bench comprising Honourable Justice J. Asoka N. de Silva, Justice Saleem Marsoof and Justice P. A. Ratnayake made this order following a fundamental rights petition filed by the Archbishop of Colombo, Archbishop Oswald Gomis filed a Fundamental Right Case at the Supreme Court on 20th November 2007, for abruptly stopping the Celebration of the Holy Mass by the Ja-ela Police on 06th October 2007.

Rev. Fr. Siri Cooray was celebrating the Sunday Mass on 06th October 2007, on the eve of Feast of Holy Rosary and after the Sunday Gospel was proclaimed, a police constable who reached Fr. Siri Cooray informed him that he has received orders from Officer in Charge of Ja-ela polce Station to asking him to stop the Mass and disperse the people in the Church. Fr. Siri Cooray obeying the Police Orders, stopped the Mass and the people were dispersed. Thereafter Fr. Siri Cooray lodged a complain at the Police Head Quarters, Colombo that the Ja-ela Police abruptly stopped the celebration of the Holy Mass and had violated his fundamental right to freedom of thought, conscience and practice the religion of his choice.

According to the No. 291 of the Penal Code, which says, " whoever voluntarily causes disturbance  to any assembly lawfully engaged in the performance of religious worship or religious ceremonies shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both"

Chapter III.Art.10 of the Constitution of Sri Lanka (1978), under the heading of " Freedom of thought, conscience and religion " clearly says,

" Every person is entitled to freedom of thought, conscience and religion, including the freedom to have or to adopt a religion or belief of his choice ".

Article of 18 of the Universal Declaration of the Human Rights, says "

" Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance. "
 
Having listened to the submissions made by the Presidential Counsel Hon. Rienzie Arsakularatne, and Wasantha Batagoda and Thejitha Koralage who appeared for the petitioner and Senior State Counsel Ms. Viveka Siriwardena appeared for the respondents, the Supreme Court, on 24th July 2008, while affirming the fundamental right of the Constitution of Sri Lanka, Chap.111.Art.10, gave orders that the construction of the Crooswatta Church to be continued, Holy Mass to be celebrated and Sunday School-Daham Pasal classes to be held and ordered the IGP to arrest any body who obstructs this order and produce them before the court.

 
 
Ja-ela Magistrate affirms the Religious Freedom of the Crooswatta Catholics

When the Crooswatta Church matter was taken up today at the Ja-ela Magistrate Courts, Hon. Magistrate Jayaki De Alwis having listened to the presentations of both the parties, affirmed the Religious Freedom in the country and said that " everyone has the right to practice one's faith" and directed the oppostion party to prersent their objections on 26th March 2008, if the Church at Crooswatta is being built on an illegal land.

Presidential Counsel Hon. Rienzie Arsakularatne made the presentations behalf of the Archbishop of Colombo and was assisted by Lawyer Wasantha Batagoda.

Church land was brought by the Archbishop of Colombo and all the necessary permission has been obtained according to the regulations in the country.

This affirmation makes the way for the Catholics at Crooswatta to practice their faith and continue to celebrate Holy Eucharist and have Daham Pasal classes [ Catechism ] for the children, who could not have classes since last September 2007.

The Archbishop of Colombo, Archbishop Oswald Gomis filed a Fundamental Right Case at the Supreme Court on 20th November 2007, for abruptly stopping the Celebration of the Holy Mass by the Ja-ela Police on 06th October 2007.

Rev. Fr. Siri Cooray was celebrating the Sunday Mass on 06th October, on the eve of Feast of Holy Rosary and after the Sunday Gospel was proclaimed, a police constable who reached Fr. Honourable Justice Dr. Shirani Bandaranayake, Hon. Judge Gamini Amaratunga and Hon. Judge Saleem Masuf presiding at the Court hearing, listened to the submission and appeals of the Presidential Counsel Hon. Rienzie Arsakularatne. Hon. Rienzie Arsakularatne also stated that the abruptly stopping the Religious Service is a violation of fundamental right to religious freedom assured in the Constitution of the Parliament. Since 06th October 2007, the Catholics at Crooswatta, Kotugoda have not been able to have Sunday Mass and the children have not been able to have Daham Pasal.

Honourable Justice Dr. Shirani Bandaranayake, Hon. Judge Gamini Amaratunga and Hon. Judge Saleem Masuf having listened to the submissions, granted Leave to Proceed for the Fundamental Right case to be taken up in the Supreme Court.

Six weeks were given to other party to present the submissions and three weeks after that to make the submissions of the defense.

Then the case will be taken up in the Supreme Court on 25th March 2008.

The Archbishop of Colombo, Archbishop Oswald Gomis filed a Fundamental Right Case at the Supreme Court on 20th November 2007, for abruptly stopping the Celebration of the Holy Eucharist by the Ja-ela Police on 06th October 2007.

Honourable Justice Dr. Shirani Bandaranayake having listened to the presentations of the Presidential Counsel Hon. Rienzie Arsakularatne on behalf of the Archbishop of Colombo and Rev. Fr. Siri Cooray,  Hon. Justice Shirani Bandaranayake requested the State Counselor to provide more information on 06th December 2007 of the documents of the Case presented, before the Supreme Court grant leave for proceedings.

 

POLICE INTERRUPTS AND STOPS THE CELEBRATION OF THE HOLY EUCHARIST

Having received the permission from the Ja-ela Magistrate Courts on 03rd October 2007, to conduct the Daham Pasal - Catechism Classes and to celebrate the Holy Eucharist in the half built church at Croos Watta, Kotugoda Parish, children gathered on Saturday the 06th October for Catechism classes. Thereafter Rev. Fr. Siri Cooray came to celebrate the Holy Eucharist for about 200 Catholics gathered in the church. Since it was on the eve of the Feast of Our Lady of Rosary, people recited the Rosary together with the children.
 
After the recitation of the Rosary, Fr. Siri Cooray started the Holy Eucharist. When Fr. Siri Cooray finished proclaiming the Gospel, a message was sent to Fr. Siri Cooray through a person by the police official who was present in the church premises.When the police interrupted the Holy Eucharist and was talking to Fr. Siri Cooray, people were frightened as to what it was.
 
The Police official informed Fr. Siri Cooray that he has received an order from the OIC of Ja-ela Police Station to stop the Holy Mass. Fr. Siri Cooray then requested the police official to convey the same message to the people. When police official conveyed the message and asked Fr. Siri Cooray to stop the Holy Mass, Fr. Siri Cooray stopped the Mass and requested the Catholics to leave the church and go home.
 

There was not a single person present objecting to the celebration of the Holy Mass, other than the police. There was no gathering of people even to object for the celebration of the Holy Eucharist. It was seen during the celebration of the Holy Mass, more policemen were arriving with arms in motor bikes and in a jeep. Catholics who were coming to the church had been dispersed by the police, threatening them not to go to the church.

 
When I asked the police official whether he was present at the Courts hearing and whether he was aware of the Court order given on 03rd October on the Crooswatta Church, he simply said," I didnot come to the Courts for this particular Case nor I am aware of the Order given at the Courts. I am only conveying the Order given by the OIC of Ja-ela Police ".
 
It was on 03rd October 2007, Magistrate Court, Ja-ela temporarily suspended the constructions of the Church at Croos Watta in Kotugoda parish and granted permission only to conduct Catechism classes and to celebrate the Holy Mass on Saturday evening.
 
There are 297 Catholic families belonging to the Crooswatta church. Due to the protest by a Buddhist monk and some people in the area, Parish Priest Fr. Chryshantha Fernando OMI , could not complete the constructions of the Church. It so happened on 08th September 2007, the Birthday of Our Blessed Mother and again police stopped the Holy Mass that was offered on the Feast of the Holy Rosary. Crooswatta church is dedicated to Our Blessed Mother.
